USA: MT accused of abducting  ‘knew this day would come’

MOUNT PENN, Pa. – One of the FBI’s most-wanted now sits behind bars nearly 3,000 miles from Berks County and the apartment she fled.
“It’s been a long three years investigating this case,” said Detective Deron Manndel, Central Berks Regional Police Department, who has been the lead investigator on the parental abduction case. “A lot of leads along the way that turned out to be dead ends.”
The search for Maria Evelia Cabrera-Gutierrez came to an end with her capture in Raymond, Washington, Monday afternoon, less than 24 hours after her case was featured on national television.
Authorities said a pair of tips that came in after Sunday evening’s airing of CNN’s “The Hunt with John Walsh” on HLN led them to Cabrera-Gutierrez and her 4-year-old son, Daniel Markus.
“Both of them basically said the exact same thing, that this woman was living in their town with two young boys going by different names, and all the details added up,” Manndel said. “It sounded like it had to be her.”
And it was. Raymond police officers and Pacific County sheriff’s deputies went to the address they were given and found Cabrera-Gutierrez.
“She didn’t give them a hard time or anything. She admitted who she was. She knew this day would come, basically,” Manndel said. “They took her into custody without any incident.”
Berks County District Attorney John Adams said the next step will be for Cabrera-Gutierrez to decide whether to waive or fight her extradition. ​
“If she does fight her return to Berks County, we will be put in a position where we will need to obtain a governor’s warrant to extradite her back to Berks County,” said Adams. “In most cases, the defendants typically will agree to come back, and she will be extradited back to our county hopefully within the next 10 days.”​​
Adams said Cabrera-Gutierrez faces a maximum sentence of seven years in prison.
The ordeal began when the boy’s father, Guy Markus, discovered that Cabrera-Gutierrez and the boy had gone missing from their apartment in St. Lawrence in November 2014, despite a Berks County judge’s order that they share custody of their son.Investigators soon learned that Cabrera-Gutierrez, Daniel, and her other son, hopped on a bus in Reading and traveled to San Antonio, Texas.
“We tracked her to Texas initially right off the bat, we were right on her tail. Then we lost her,” Manndel said. “Lots of leads and tips were received over the years. Some of them seemed more promising than others; some of them led to dead-ends.”
Cabrera-Gutierrez is facing charges of interference with the custody of a child and concealing a child’s whereabouts, as well as flight to avoid prosecution by the FBI.
As for Guy Markus, the boy’s father, Manndel said he was on the first flight he could get to Seattle.
“He was ecstatic,” Manndel said. “Once everything was good to go, he was on his way to the airport in Philly.”
Manndel said officials are still trying to arrange for custody of Cabrera-Gutierrez’s older son, who has a different father.
“All the contact information was given to child protective services to try to reach out to his father in California, so hopefully they can be reunited, as well,” he said.

Cold Case Carries Death Sentence

The first-degree felony murder charges carry the possibility of a death sentence, but it wasn’t known before the hearing if prosecutors had agreed not to pursue the death penalty in exchange for Welch’s guilty pleas.
He was scheduled to go on trial Tuesday, but his trial request was withdrawn last week…….The Washington Post reported that Welch plans to plead guilty in an agreement that will also resolve two unrelated sexual assault cases against him………Welch is already serving a long prison term in Delaware for sexually molesting a 10-year-old girl……

Facts: Child was born in Guatemala 16 years ago. Child’s father abandoned the family over four years ago. Child’s mother struggled to provide for the family, which forced Child to drop out of school after the sixth grade because his mother was too poor to pay for him to continue. After dropping out of school, Child worked in the cornfields. Child’s family ate once or twice a day and typically ate only the corn they grew.
In 2015, Child left Guatemala and traveled to the United States, where he was apprehended by immigration authorities. He was placed in the temporary custody of his paternal uncle in Tennessee. Child has lived in Tennessee since that time, and has been enrolled in school in Tennessee.

So Karen, I just wanna be clear on this, you’re saying that there is nothing in your current book that you derived from AB-PA?  That’s what you saying, right?  That you incorporated nothing from AB-PA into the model for the pathology that you are proposing we use, right?
It is entirely 100% you – that’s what you’re saying, right?
This is the model you’ve been using and developing and proposing for the past 25 years, right?  Nothing from AB-PA.

A Scottish teacher jailed for abducting his 15-year-old pupil to France could face prison time after his victim revealed that he contacted her on Facebook. 
Aberdeenshire born Jeremy Forrest sparked an international manhunt when he fled to France with a 15-year-old pupil, who cannot be named for legal reasons, in 2012. 
His victim, has spoken out for the first time about their relationship and the events that led to his arrest and trial.
She also revealed to Cosmopolitan that Jeremy attempted to contact her on social media networking site Facebook after his release from prison.
She said: “Since Jeremy’s release from prison, we have only spoken once, about a year ago, after I messaged a Facebook account with his name that came up as a suggested friend.”
“He sounded the same and, importantly, happy – he even had a new girlfriend.”
The message exchange may prompt an investigation as it breaches a licence that ordered Jeremy not to have contact with her. 
Forrest, originally from Inverurie in Aberdeenshire, was a married maths teacher at Bishop Bell School in Eastbourne, East Sussex, when he began a sexual relationship with one of his students. 
He was convicted for five-and-a-half years and was released from prison two years ago. 
The 15-year-old revealed the pair got close on a school trip to the USA when she was just 14. The pair began exchanging messages on Twitter before starting to meet up regularly outside of school. 
The girl, referred to as Gemma for legal reasons, had sex with the maths teacher who she thought of as her boyfriend, after her 15th birthday. 
The pair took a ferry to France under false names in a bid to set up a new life.
Forrest was spotted in Bordeaux and arrested eight days later. 
She said: “Of course we knew it was illegal for us to be together, but we genuinely believed that if we stuck it out for a tricky few years, eventually we could return home and people would accept our relationship.”
“Right up until the very last moment I thought things might be OK, and that people would understand how we’d fallen in love, but when he was found guilty of child abduction and sex with a minor, I broke down in the dock beside his family.”
The pair had not seen each other since 2013 at Lewes Crown Court in East Sussex when she was forced to give evidence against Jeremy during the trial. 
Speaking of their relationship Gemma* revealed she never felt like a victim and she had encouraged his advances.
She said: “I’m still asking myself that now. All I know is, at the time, it didn’t feel that way; it was me who followed Jeremy on Twitter and I welcomed the advances he made in response.”
Since his release Jeremy has reinvented himself and found a new relationship, despite claims he would return to the girl after his release.

The book, Talking About Terrorism, published weeks before the , describes the indiscriminate mass murder of innocent members of the public as a “type of war”.It tells primary age children that terrorists kill people because they believe they are being treated “unfairly and not shown respect”. It gives examples of “” whose ideas then turn out to be right: “The Suffragettes used violence and were called terrorists,,,,” it stated.

In an activity recommended for pupils aged seven to 11, teachers are urged to “invite children to write a letter to a terrorist. If they could ask a terrorist six questions, what would they be?”The book, published by Brilliant Publications and containing a foreword by Peter Wanless, the chief executive of the NSPCC, has been slammed by critics who say it is potentially dangerous. Chris McGovern, chairman of the Campaign for Real Education, said the letter task would confuse and potentially upset pupils.

In trying to help children “understand” terrorists’ motives, the book invites sympathy for the killers, critics claim.
And by invoking the Suffragettes and Nelson Mandela, it leads children to question whether terrorism might be justifiable, they say.

Judge Accused of being “Bent as a Banana” in child abuse case

Investigative journalist Richard Carvath has called Judge Jeremy Lea “as bent as a banana”

It has been hard to work out the truth of this case in Nottinghamshire.
Partly this is due to
  • lack of information
  • court restrictions
  • having worked out the establishments official story, there is the problem of judging how close this is to the truth.
Naturally I have no wish to adversely affect any cases that may be brought, nor do I wish to fall foul of any restrictions that I do not even know about.
It appears a family court judgment made a mothers two boys, ward of the court. It was critical of her but the mother (Samantha Baldwin) ignored the judgment took the children with her, against the wishes of the authorities. She was “missing” for several days and then went to police who have taken now taken the children from her. In the meantime the police and family courts have issued statements. It appears that family members were threatened with charges of helping the mother take the children.

This post summarises what was known on the 3rd and 4th of April and has links to several corporate media articles if people wish to research them. They do not seem to add much to the facts, and corporate media almost never link to sources, so I will not reference them here.
The Transparency Project article states that on 27 Mar the Family Court held a hearing about these two boys. It decided to declare the boys wards of court. Probably on 3 Apr the Family Court then issued a statement via the police website, which now appears to be unavailable, which included
Miss Baldwin is now missing. It is assumed that she has abducted [the children]. The children have now been made wards of Court. Miss Baldwin is considered to pose a risk of harm to the children.”

Superintendent Richard Fretwell of Nottinghamshire Police was in charge of the search for Samantha Baldwin.
The article then explains some useful definitions such as abduction and custody.

The article states
  • the mother made allegations of sexual abuse of the boys by the father, and others, some years ago;
  • these were the subject of a lengthy fact-finding hearing very recently (12 days, which is a significant duration for a trial in a private law case), but it seems likely that any criminal investigation associated with this hearing did not lead to charges against the father;
  • after 12 days of evidence from the parents, and a host of other witnesses and consideration of more than 2,000 pages of documents, the judge decided that the mother had failed to prove that it was more likely than not that her allegations were true, although she did genuinely believe them to be true;
  • more than that, he found that she was so convinced that the allegations were true that she had gone to the lengths of drugging the boys in order to bolster the case that the children were victims of abuse – in essence she fabricated evidence in the hope of securing the finding she believed was justified;
  • and the judge found that when the mother realised the writing was on the wall, she made a plan and then whisked the children away to her chalet to prevent the court from acting on its judgment.
  • The children are now temporarily in foster care – the reason given for them not returning immediately to the care of their father is that as a result of their mother’s own irrational belief, they may now have a false belief that they were in fact abused by their father. It also appears that they have not had contact with, let alone been cared for by their father for some years.
That then appears to be a summary of the official position. Supporters of Samantha Baldwin, which include investigative reporter Richard Carvath think this is not an accurate picture. He also claims court papers have been served on him and he has been gagged.
He says that he has to balance getting the truth to the public whilst still protecting the legally admissible evidence that is needed to seek justice for them. (OBO stands for On Behalf Of, and it appears that someone is operating his twitter account, presumably with his permission)

Family violence is an issue that we as social workers will probably encounter during the course of our careers. While there are many forms of family violence, I view child abuse and neglect as the worst forms. Nothing bothers me more than knowing that somewhere, someone is abusing a completely helpless individual. I view it as our duty not only as social workers but also as humans to ensure that no child has to experience the pain and suffering involved with child abuse and neglect. This may seem like an impossible task, people have been trying for years to end child abuse with no success. I believe, however, that we have the ability to end the threat of child abuse. NCANDS defines neglect as, a type of maltreatment that refers to the failure to provide needed, age-appropriate care. Medical neglect is the failure to provide needed medical attention to a child when financially able to do so, or offered other means by which you can obtain the needed care. Emotional abuse is commonly defined as a pattern of behavior that can seriously interfere with a child's positive emotional development (American Humane Association, 1999).
These definitions for the most part are meant to be guidelines not absolute definitions. A mother, who playfully threatens her child that she will be angry if she doesn't get a kiss on the cheek, will not be charged with sexual abuse even though it fits the legal definition. As social workers we must be prepared to allow for cultural differences in child rearing practices and not be quick to judge. What may seem like child abuse to one culture may not be considered abuse by another. "The vast majority of cases fall in a grey area between the extremes. Within this grey area, the decision to report an incident is a function of societal standards of acceptable child rearing practices, legal definitions of abuse and neglect, and an individual's own value system" (Rubin, 1992). It is also this lack of a clear, exact, and widely accepted definition of child abuse that hampers us in our fight to end it.

Experts will often describe the abuse that is reported as the tip of the iceberg. This research attempts to measure the whole iceberg. “
It can be overwhelming to think about the number of people who either are, or were, abused during childhood. I prefer, instead to think about the number of people who have had this terrible experience, and been able to overcome it. That number should be our inspiration and our hope as survivors, while also motivating us to do better to prevent more children from having to experience it in the first place!
